Public Employees Health Program (PEHP)

Salt Lake City, Utah, PEHP Benefits Attorney

If you work for the state of Utah or a local agency within the state, you are most likely covered under Utah's state entitlement program - the Public Employees Health Program (PEHP) for long-term disability benefits. At The Law Office of Andrew Reichardt in Salt Lake City, we can help you file your PEHP long-term disability claim or appeal a denial.

If you pursue a PEHP claim, the policy requires that you file a social security disability claim with the Social Security Administration (SSA) as well. Our law firm can represent you in both claims, reducing the worry and hassle of working with multiple attorneys in dealing with the SSA and the state of Utah.

If Your PEHP Claim Has Been Denied

Claims under the Public Employees Health Program policy are often wrongly denied. This is true even for claimants who clearly deserve benefits. People who file PEHP claims often face two major issues:

  • Getting offered only 2/3 of what you deserve. If you were injured while you were on the job working, the PEHP policy says that you are entitled to 100% of your salary while you are disabled. If you are injured off the job, you are eligible for only 2/3 of your salary. The trouble is that PEHP often tries to award people the 2/3 amount - even if they've been hurt on the job. Moreover, the PEHP frequently will not notify you of the amount to which you are truly entitled.
  • Getting told that you could go back to work. Many times, PEHP denies claims outright. People are told that they could go back to work, even when they have physical impairments or mental impairments that clearly prevent them from doing their jobs.

The Law Office of Andrew Reichardt will be your dedicated advocate at all levels of appeal, including the Utah State Retirement Board and state court, if necessary. However, you must act quickly to protect your best interests. PEHP has strict deadlines for appeal. If you don't act, you may lose your rights under the policy.
